Sexual or romantic relationships may raise concerns of conflict of interest, abuse of authority, favoritism, and unfair treatment when both people are in the MIT work or academic environment, and one person holds a position of power or authority over the other. These relationships may also affect others in the work or academic environment, undermining the integrity of their supervision and evaluation as well. These concerns exist even when the relationship is considered consensual by both individuals.
In some instances, consent may not be as freely given as the more senior person in the relationship believes. Because of the possible adverse effects on the other party and on their fellow students, co-workers, colleagues, and others, the Institute prohibits all faculty, other academic instructional staff, other employees, and other non-student members of the MIT community paid or unpaid from having sexual or romantic relationships with certain MIT students and employees, whether or not the relationship is consensual.
A summary of this policy is as follows, with more detail in the noted sections:. Where this policy imposes a duty to notify and recuse, that duty falls on the person in the position of power or authority in the relationship. Where required, notification and recusal must take place as soon as practical after any action has been taken by either party to establish a sexual or romantic relationship.

Consensual Relationships Policy
This relationship vests considerable trust in the teacher, who, in turn, bears authority and accountability as a mentor, educator, and evaluator. The unequal institutional power inherent in this relationship heightens the vulnerability of the student and the potential for coercion. The pedagogical relationship between teacher and student must be protected from influences or activities that can interfere with learning and personal development.
Whenever a teacher is or in the future might reasonably become responsible for teaching, advising, or directly supervising a student, a sexual relationship between them is inappropriate and must be avoided. In addition to creating the potential for coercion, any such relationship jeopardizes the integrity of the educational process by creating a conflict of interest and may impair the learning environment for other students.
Finally, such situations may expose the University and the teacher to liability for violation of laws against sexual harassment and sex discrimination.

If individuals already in an Intimate Relationship foresee the possibility of entering into a relationship of power or authority for example, through one party enrolling in a program or a class, or taking up a new position , or where an Intimate Relationship arises in the context of an existing relationship of power or authority, the individual with supervisory, evaluative or other position of authority and power must notify the relevant supervisors, directors or deans immediately.
The relevant supervisor, dean or director shall have the authority, in consultation with the Office of Equal Opportunity, to set reasonable conditions to eliminate both the substance and appearance of conflict of interest or abuse of power or authority; to prevent the establishment of direct authority; to minimize and attenuate indirect authority; or to grant an exception to the policy; provided, however, that exceptions will be granted only in extenuating and extraordinary circumstances.

The University establishes this personnel policy to address conflicts of interest arising from interpersonal relationships not otherwise covered by existing policies or law.
The intent of this policy is to direct employees to disclose relationships that have created or may create conflicts of interest and to give the University an opportunity to manage and reconcile any such conflicts, if possible. Employees who violate this policy may be subject to disciplinary action; however, because this policy is designed to encourage employees to disclose personal relationships that may give rise to or have given rise to conflicts of interest, an alleged violation of this policy may not be a basis upon which employees may file grievances against one another.
Relationships with Students Outside the Instructional, Supervisory, or Evaluative Context: Romantic or sexual relationships between employees and students when the employees do not have a direct instructional, supervisory, or evaluative responsibility with respect to the student are not per se prohibited.
They may, however, result in a conflict of interest, particularly when the employee and student are in the same unit or in units that are allied. In such situations, employees shall remove themselves from any decisions that may reward or penalize students with whom they are or have been romantically or sexually involved. An employee violates this policy and his or her obligation to the student, to other students, to colleagues, and to the University when such employee participates in decisions that may reward or penalize a student with whom the employee has, or has had at any time, a romantic or sexual relationship.
Relationships with Employees and Students in Other Contexts: No University employee shall engage in a romantic or sexual relationship with another employee when one of those employees supervises or evaluates the other employee. No employee may supervise another employee or student with whom that employee lives, whether or not the individuals are engaged in a romantic or sexual relationship. If the immediate supervisor deems the plan unsatisfactory, then the supervisory employee may submit the plan to the next administrative level for review and acceptance or rejection.
The plan may include altering supervisory or reporting lines; moving a student to another section of the same class; appointing a different individual to serve on a thesis, dissertation, or evaluative committee; moving a supervisor or other individual to another position of the same or comparable status and duties; or establishing alternative means of evaluation of academic or work performance.

Indeed, consensual romantic or sexual relationships that occur in the context of educating, supervising, evaluating or mentoring students can be disruptive to the educational environment, not only to those involved in the romantic or sexual relationship but also to people around them. If an employee has a concern as to whether a relationship falls under this policy, the employee may seek confidential guidance from the Ombuds Office. Any faculty, staff, or administrator who is in a romantic or sexual relationship with another member of the RIT community over whom they have Authority, because of the inherent power differential that comes with that Authority, raises significant ethical, administrative, and legal risks, such as sexual harassment and perceptions of favoritism and preferential treatment.
Therefore, employees should be aware that entering into a Consensual Romantic or Sexual Relationship where there is a power differential creates the potential for risk to both parties. For the purposes of this policy, it is irrelevant whether the Employee is a Supervisor or exercises Academic Responsibilities with respect to the Student. The university prohibits any Supervisor from having, pursuing, or maintaining a Consensual Romantic or Sexual Relationship with any Employee who reports to the Supervisor.
While the policy prohibits certain Consensual Romantic or Sexual Relationships, the university understands that there may be the need for exceptions in rare circumstances.
